Competition Terms and Conditions

1. The promoter is Evercare Health Pty Ltd (Evercare) of 256 Junction Road, Clayfield Queensland, 4011. ABN:

2. Information on how to enter and prizes form part of these Conditions of Entry. Entry into this promotion is deemed acceptance of these Conditions of Entry. Entry is via www.evercare.com.au

3. Entry is free and open to residents of Queensland, Australia, aged 18 years or older who submit the form via the Evercare website during the promotional period. Employees and immediate family members of employees are ineligible to enter. The competition is open to existing Evercare Members as well as the general public. The winner should live within 100km of Clayfield, Brisbane in order to redeem their prize at Evercare’s Clayfield location.

4. This promotion commences on 1 November 2023 and ends at 5pm on 30 November 2023 (AEST, Australian Eastern Standard Time). To enter the promotion, participants must complete the entry form at evercare.com.au during the promotional period. The maximum amount of times an individual can enter is one. Any entries that exceed this amount will be disqualified and will not be counted at the prize draw. After the close date, no further entries to the competition will be permitted. The maximum number of daily prizes that a competition entrant can win is one. If an entrant wins a daily prize, they will be excluded from future daily prize draws in this promotion.

5. By entering this competition, an entrant is indicating his/her agreement to be bound by these terms and conditions.

6. No responsibility can be accepted by Evercare for entries not received for whatever reason.

7. Daily prize winners will be chosen through random selection from all valid entries received and verified by Evercare, excluding previous daily prize winners in this promotion. The grand prize winner will be chosen through the random selection from all valid entries received and verified by Evercare.

8. The winners will be notified via phone or email within 2 days of the draw. If a winner cannot be contacted or does not claim the prize within 5 of notification, we reserve the right to withdraw the prize from that winner and to pick a replacement winner.

9. If there are any unclaimed or un-awarded prizes, a draw will be conducted on 8th December 2023. The winner/s of this draw will be notified via phone or email within 2 business days of the draw and will have their name published on www.evercare.com.au and via Evercare’s social media networks.

10. The winners will be announced each Monday morning (for the previous week) during the competition period as follows: Monday 6th November, Monday 13th November, Monday 20th November, Monday 27th November, Monday 4th December . Announcements will be made on Evercare’s official website and social media channels.

11. The winner/s agree to the use of his/her name in their entry. Any personal data relating to the winner or any other entrants will be used solely in accordance with current data protection legislation and will not be disclosed to a third party without the entrant’s prior consent. This competition and Evercare operates under the Australian Privacy Principles under the Privacy Act, and the information provided will be used in conjunction with the following Privacy Policy found at https://evercare.com.au/legals/

12. The Promoter’s decision is final and no correspondence will be entered into.
13. In the event of war, terrorism, state of emergency, disaster or any other circumstance beyond the control of Evercare, the Promoter reserves the right to either provide an alternative prize to the same value as the original prize or, subject to any applicable laws or written directions made under applicable legislation, to cancel, terminate, modify or suspend the promotion. Any changes to the competition will be notified to entrants as soon as possible by the promoter.

14. The total prize pool is valued at $1,890 as at 1/11/2023. Evercare accepts no responsibility for any variation in the prize value. Prize of any unused portion of the prize is not transferable or exchangeable and cannot be taken for cash.

15. The prize consists of 30 one-month Evercare memberships, valued at $45 each (adult). The grand prize is an annual membership for Evercare valued at $540 (adult).

16. The prize is non-refundable. The prize may be transferred to an immediate family member. If the winner is an existing Evercare member, the prize will be redeemed against their current membership.

17. Winners of the Evercare memberships will be subject to additional costs for consultations with a GP using Evercare services. Providing he/she has a current Medicare card, they will be eligible for reimbursement of appointment fees by Medicare, subject to Medicare’s terms and conditions.

18. Winners must redeem their Evercare memberships within 1 month from the date of winning. To redeem their prize, winners will need to provide some base details and then download the Evercare app and provide their Medicare details. In order to book an appointment with a GP, a credit card will need to be added to the app to enable the consultation fees to be paid (reimbursed by Medicare).

19. All entries and any copyright subsisting in the entries become and remain the property of Evercare. Evercare collects contact information about entrants in order to contact them about the promotion and where appropriate award prizes and may also use the information to assist the Promoter in improving goods and services and to contact entrants in the future with special offers via any medium including mail and commercial electronic messages. If you do not provide the information, you cannot participate.

20. Evercare reserves the right in its sole discretion to disqualify any individual where there is reason to believe they have breached any of these conditions, or engaged in any unlawful or other improper misconduct calculated to jeopardize the fair and proper conduct of the competition. Evercare’s legal rights to recover damages or other compensation from such an offender are reserved.

21. Evercare reserves the right to modify, suspend, or terminate the competition at any time without notice.

22. Evercare is not responsible for any problems or technical malfunction of any telephone network or lines, computer online systems, servers, or providers, computer equipment, software, technical problems or traffic congestion on the Internet or at any website, or any combination thereof, including any injury or damage to participants or any other person’s computer related to or resulting from participation in or downloading any materials in this promotion.

23. The laws of Australia apply to this promotion to the exclusion of any other law. Entrants submit to the exclusive jurisdiction of the courts of Australia. The terms and conditions of this promotion adhere to the trade promotion lotteries associated with each individual state within Australia. This promotion is governed by the laws of Queensland, Australia.
